We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation, if you breach these Terms and Conditions. Upon termination, your right to use the service will cease immediately. Please note that The K.A.P.S. Disaster Hub is a zero-tolerance platform. Violation of any of our terms and agreements may lead to immediate account deactivation and permanent closure without a refund of any kind.
To the maximum extent permitted by applicable law, in no event shall The K.A.P.S. Disaster Hub or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the service, third-party software or third-party hardware used with the service, or otherwise in connection with any provision of this terms), even if The K.A.P.S. Disaster Hub or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Some states do not exclude implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.
You hereby agree to indemnify The K.A.P.S. Disaster Hub and all those (directly/indirectly) associated with either party against all damage, liability, claims, demands, expenses, actions, costs, and loss, as well as legal fees and expenses, incurred, as a result of the services provided, rendered this Agreement or any transaction or matter connected with these services or the relationship between you and the company. This clause shall not be read to provide indemnification for any party if a competent court of law, rendering a final judgment, holds that the party’s bad faith, gross negligence, or willful misconduct caused the damage, liability, or loss.
The Parties hereby acknowledge and agree that nothing in this Agreement shall be deemed to constitute a partnership, joint venture, agency relationship, or otherwise between the Parties and that this Agreement is for the sole and express purpose of the rendering of the specific services as outlined under the terms and conditions herein..
“AS IS” and “AS AVAILABLE” Disclaimer
The service is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind, to the maximum extent permitted under applicable law, The K.A.P.S. Disaster Hub, on its behalf and behalf of its Affiliates and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, for the service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.
Without limitation to the foregoing, The K.A.P.S. Disaster Hub provides no warranty or undertaking, and makes no representation of any kind that the service will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards or be error-free or that any errors or defects can or will be corrected without limiting the preceding, neither The K.A.P.S. Disaster Hub nor any of the organization’s providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the service, or the information, content, and materials or products included thereon; (ii) that the service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the service; or (iv) that the service, its servers, the content, or e-mails sent from or on behalf of The K.A.P.S. Disaster Hub is free of viruses, scripts, trojan horses, worms, malware, timebombs, or other harmful components..
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you. But in such a case, the exclusions and regulations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
The laws of the Country, excluding its conflicts of law rules, shall govern this terms and your use of the service. Your use of the application may also be subject to other local, state, national, or international laws.

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.
You represent and warrant that (i) you are not located in a country that is subject to the United States government embargo, or the United States government has designated that as a “terrorist supporting” country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Except as provided herein, failure to exercise a right or require performance of an obligation under these terms shall not affect a party’s ability to exercise such right or require such performance at any time after that, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
These Terms and Conditions may have been translated if we have made them available to you on our service. You agree that the original English text shall prevail in the case of a dispute.
Opening a Subscription
Any organization that has an active EIN number can acquire a subscription.
Subscriber Verification
All organizational subscribers must submit a copy of their EINs and go through a multi-process verification. Once your organization is verified, you will have full access to the platform. By agreeing to use the platform, you acknowledge that The K.A.P.S. Disaster Hub will verify the EIN of every organization to ensure they are an active organization. However, The K.A.P.S. Disaster Hub does not 100% guarantee that all organizations are involved. Users should use their best judgment when connecting and communicating with organizations. If a subscriber has any concerns about another subscriber, please immediately send an email to thekapsdisasterhub@gmail.com. We strive to create a safe place for all, but that also requires teamwork in reporting any concerns.
Subscription
Each subscription is good for only one year and must be renewed before the year ends to prevent losing access to the platform. The subscription for this year is $150.00. Future subscription fees may increase. Users will receive a notification ahead of time. This year’s fee will only cover access for 365 days. To continue using our services, the user will need to renew their access, or the account will deactivate, which may cause the account and all of its content to be deleted—the K.A.P.S. Disaster Hub is not responsible for the loss of information/data/connections.
Purchasing a subscription also means that you agree to the terms and conditions outlined in this service agreement and take full responsibility for their actions and activities related to this platform. The user agrees to hold harmless The K.A.P.S. Disaster Hub, L.E.E.D. With Joy, its subsidiaries, and those contracted or directly employed in any form by this or an associated company. The user agrees to hold harmless any partnering institutions, and if an issue does arrive, the user will contact The K.A.P.S. Disaster Hub immediately and wait for a response before seeking outside help/resources.
Community Rules
Site Usage
By using the site, the user agrees not to sell or freely distribute information associated with this platform in any manner to anyone. All data used to build the website, including but not limited to the site’s structure, the site’s content, design, etc., is under copyright, U.S. Trademark protection, and has a patent-pending status. Distributing any information regarding this website or its content is a violation and will place your account at risk for immediate removal and place the user and their assets at risk for legal dispute. If the user violates the terms and both parties go to court, the user agrees to pay court fees, attorney fees of you, and for The K.A.P.S. Disaster Hub and all those associated with the hub, including legal counsel.
Research
The K.A.P.S. Disaster Hub is a subsidiary of L.E.E.D. With Joy L.L.C.. L.E.E.D. With Joy L.L.C. periodically conducts research studies and publishes those studies in journal articles, books, and other media outlets to help researchers and practitioners understand how best to help marginalized communities and organizations supporting those communities. By agreeing to use our services, you understand that your activity on the site may be documented and published for research purposes.
In contrast, we will declassify and not publish any personal information. The users understand that by using our services, they permit us to examine every aspect of their account for external and internal research purposes. Internal research will be used for quality assurance efforts. External analysis will be analyzed and published in academic journals, books, and other material. to develop best practice procedures and advice for practitioners/researchers alike. Our goal is to conduct this research to promote professional growth and produce scholarly research to help scholars, practitioners, and communities develop best practices to work with communities.
Items that cannot be distributed on the site
The K.A.P.S. Disaster Hub follows the state laws of Louisiana and the United States Federal Laws. A subscriber cannot engage in the distribution of products that are illegal based on the laws identified by the state of Louisiana. These items can include by are not limited to the sell or distribution of recreational drugs, pornography services, sex services of any kind etc. If a subscriber is caught selling or distributing any of these products as described above or any other product that violates the service agreement the subscribers account will be immediately deleted. The K.A.P.S. Connect platform is designed to provide a safe environment for organizations to communicate and provide resources to the communities any person (account) engaging in activities or conduct that goes against our safe space policy will be immediately deleted.
Contract Workers
The K.A.P.S. Disaster Hub will periodically hire contract workers to produce videos, blogs, vlogs, podcast content, and other administrative duties. Any person hired under these purposes is a service provider only. We do not hire employees. They are responsible for paying their own federal, state taxes at the end of each year.
Refunds
All subscriptions are final sales. We do not offer a refund for a subscription. Once you purchase a subscription at $150.00 a year, you will access the site’s full capabilities.
Reporting a vendor?
While The K.A.P.S. Disaster Hub is not responsible for any actions of another subscriber that exist on the platform. We will do our best to mediate problems. Please report an issue with a vendor directly to thekapsdisasterhub@gmail.com.
Prohibited activities that cannot be conducted on the site
The K.A.P.S. Disaster Hub follows the state laws of Louisiana and the United States Federal Laws. A subscriber cannot engage in the selling or distribution of illegal products based on the statutes identified by Louisiana. These items can include by are not limited to the sell or distribution of recreational drugs, pornography services, sex services of any kind. If caught soliciting or purchasing any of these products described above or any other product that violates the service agreement, the user’s account is immediately deactivated.
At our sole discretion, we reserve the right to modify or replace these terms at any time. If a revision is in material format, we make reasonable efforts to provide 30 days’ notice before any new terms take effect. At our sole discretion, we determine what constitutes a material change.
By continuing to access or use our service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
